Football League To Sue Their Legal Advisors!

By: Bill Osborne
Date: 22/09/2004

THE Football League are sueing the solicitors who advised them on the ITV Digital deal for damages relating to the termination of the agreement which left many clubs in financial trouble.

Football League chairman Sir Brian Mawhinney confirmed that High Court proceedings have been issued against Hammonds, previously known as Edge Ellison, the legal advisors to the League during contract negotiations with ITV Digital in 2000.

The League released a statement which read: "The League's board of directors have taken this decision having considered detailed advice from leading counsel.

"The League's proceedings claim that during the negotiation and completion of its broadcasting agreement with ITV Digital (at the relevant time known as OnDigital), Hammonds were negligent and/or in breach of contract and failed to protect the League's interests. They include a claim for substantial damages."

The League cannot say any more about the proceedings as they are now sub judice but it is likely that the failure of getting guarantees from the ITV Digital parent companies may constitute the claim of negligence.

Naturally, the league clubs will be delighted with the move and will be hoping that a successful outcome will benefit them financially. If it gets to a jury, it would be hard to estimate exactly how much. So a decent offer might be enough.
